Terms of Service
The terms below describe how this website and Vittoria Fiore Gallery's services actually work.
1. Service Provider
The service provider and website operator is Vittoria Fiore Gallery. Full registered business name, legal form, registered address, tax ID (NIP) and business registry number (REGON): Vittoria Fiore Gallery Viktoriya Maksysko, ul. Hoserów 56/2, 02-995 Warszawa, Polska. Tax ID (NIP): 9512608235, Business Registry Number (REGON): 540039076 (“Vittoria” or the “Service Provider”). The Service Provider may be contacted using the details shown on the Contact page, including email, telephone, the contact form and WhatsApp where enabled. These Terms govern use of the website and the arrangement and performance of floral services, workshops, wedding and event services, services for businesses and hotels, flower subscriptions, and bespoke bouquets and arrangements.
2. Enquiries and Conclusion of Contracts
The website currently serves mainly to present the offer, submit enquiries and initiate reservations/contact. Unless a specific feature expressly states otherwise, submitting a form does not itself automatically conclude a contract or create a payment obligation. Vittoria may prepare an offer or quotation based on an enquiry. A contract is concluded once the parties agree at least the subject matter, price and date in a manner appropriate to the service, for example by email, telephone or in person. Before a contract is concluded, the customer receives the information required by applicable law for the relevant transaction.
3. Prices, Payments and Deposits
Where a final price is not displayed on the website, it is agreed individually before the order is confirmed. The website does not currently process online payments. The payment method, due date and any deposit are agreed with the customer before final confirmation. Vittoria will not impose fees, penalties or non-refundable amounts that were not clearly agreed in advance or that would conflict with mandatory law.
4. Flowers, Natural Variation and Substitutions
Flowers and plants are natural products. Minor differences in shade, shape, size or stage of bloom compared with reference images are acceptable where they do not materially affect the agreed character and quality. Availability of specific varieties, colours and floral materials may depend on season and supply quality. If an agreed item is unavailable or unsuitable for professional use because of quality, Vittoria may propose a substitute of as similar a character, quality and value as reasonably possible; a material change to the agreed colour palette, style, character or value requires agreement with the customer. This section does not limit statutory rights where the supplied goods or service do not conform to the contract.
5. Bespoke Work
Bouquets, arrangements and decorations made to the customer's individual specification are prepared for that specific order. For distance contracts, the statutory right of withdrawal may not apply, among other cases, to non-prefabricated goods made to the consumer's specifications or clearly personalised, and in other situations listed in Article 38 of the Polish Consumer Rights Act. Exclusion of the right of withdrawal does not exclude statutory rights concerning defects or lack of conformity.
6. Delivery and Collection
Delivery in Warsaw and surrounding areas may be arranged individually. Availability, timing and cost are communicated before final confirmation. The customer should provide accurate delivery and contact details. Risk and liability are governed by mandatory law and the terms of the specific contract.
7. Floristry Workshops — Cancellation Policy
The following is an additional contractual cancellation policy for public workshops on published dates and applies subject to mandatory consumer rights. Cancellation at least 7 hours before the workshop entitles the participant to a full refund of the amount paid. Cancellation less than 7 hours but at least 3 hours before the workshop normally does not entitle the participant to a refund, but the participant may transfer the booking once to another available date of the same or a suitable workshop, subject to availability. Cancellation less than 3 hours before the workshop, or a no-show, normally does not entitle the participant to a refund; Vittoria may exceptionally agree to reschedule, which is not an automatic entitlement. A participant may transfer the place to another person without an additional fee after notifying Vittoria and providing the information necessary to administer the booking. If Vittoria cancels a workshop, the participant may choose a full refund or a free transfer to another available date; if Vittoria changes the date, the participant may accept the new date or cancel for a full refund. Private, closed and corporate workshops may have individually agreed cancellation, rescheduling, deposit and minimum-participant terms communicated before the contract is concluded. Floristry workshops held on a specified date or period, with limited capacity, may fall within the statutory exception to the right of withdrawal under Article 38(1)(12) of the Polish Consumer Rights Act, which concerns certain services related to, among others, leisure, and entertainment, sporting or cultural events performed on a specified date or period; final confirmation of this classification for a specific booking will follow before paid online workshop bookings are launched. Regardless of whether a statutory right of withdrawal applies in a given case, Vittoria Fiore Gallery grants workshop participants its own, more favourable cancellation and rescheduling terms set out in this section — these terms apply independently of, and do not depend on, the statutory right of withdrawal. Where a statutory right of withdrawal applies in a particular case, this section does not restrict it.
8. Consumer Right of Withdrawal
A consumer entering into a distance contract generally has a statutory right of withdrawal within the period provided by the Polish Consumer Rights Act, unless a statutory exception applies. Exceptions may include goods made to the consumer's specifications or clearly personalised and other situations listed in Article 38 of that Act. Information on withdrawal rights for a specific transaction must reflect the actual nature of the service/goods and the way the contract is concluded. Nothing in these Terms restricts rights that cannot lawfully be waived by a consumer.
9. Complaints
A customer may submit a complaint concerning goods or services using Vittoria's contact details. Because flowers are natural and perishable, customers are encouraged to report visible issues promptly after collection or delivery and, where possible, provide photographs; this recommendation does not shorten statutory deadlines or remove statutory rights. Consumer complaints are handled under the applicable rules on conformity of goods with the contract and liability for services. These Terms do not limit statutory consumer remedies.
10. Weddings, Events, Businesses, Hotels and Subscriptions
Scope, schedule, price, delivery, installation, removal, deposit and other conditions for larger or recurring projects are agreed individually before the contract is concluded. A flower subscription does not automatically renew or automatically charge the customer unless a separate future mechanism is expressly accepted by the customer after clear prior information. Individually agreed terms for a specific order prevail over general terms to the extent permitted by law.
11. Liability and Force Majeure
Vittoria is liable for performance of the contract under applicable law. These Terms do not exclude or limit liability that cannot lawfully be excluded. Vittoria is not liable for non-performance or delay to the extent caused by circumstances beyond its reasonable control, subject to mandatory consumer rights and Vittoria's duty to inform the customer promptly and take reasonable steps to mitigate the consequences.
12. Personal Data and Final Provisions
Personal-data processing is described in the Privacy Policy and cookies/similar technologies in the Cookies Policy. These Terms do not exclude or restrict mandatory consumer rights. The current Terms are available on the website. Changes do not prejudice acquired rights or already concluded contracts unless required by mandatory law.
